Can a company obtain money/unsecured loan from a trust in which trustees of such trust are holding shares in the that Company.

Please tell me the relevant provision if it is possible.

I have to change the name and object of the Co. & convert Private Limited Co. into LLP.
Should i change name and object first then convert or Firstly convert it into LLP and then change name and object??

Can a company issue preference shares having both option of redemption as well as conversion?

As ADT-1 is for intimation by co. to ROC that we have appointed/re appointment of auditor...However, my query is whether co. is required to file ADT-1 when co. is doing ratification of auditor ??

Case is pvt. ltd Co. appointed auditor for 5 years from 01-04-2015 to 31-03-2016 in september 2015 & filed ADT-1....while doing ratification of auditor in 2nd year i.e AGM held in September-2016 ...Whether again ADT-1 in the year 2016 is required to be filed or not ???

Can a Pvt.Ltd.Company issue preference shares to the persons who are not equity share holders? Can proceeds of preference shares be used for repayment of existing unsecured loans? What is the longest period for which redeemable preference shares can be issued? At what price preference shares be issued? Can preference shares be issued on premium?

Section 8 Company has been incorporated on 21 oct-15, but no auditor has been apppointed till date i.e 25feb-16. Whether auditor can be appointed now by convening an E.G.M and whether there attracts any penalty apart from Additional filing fee with ROC.

I got LLP name approved for conversion of proprietorship firm into LLP. But now I want to close Proprietorship and start new LLP (without conversion). I want to surrender approved name. And can i apply for same name for creation of new LLP.

a company has failed to file AOC-4 XBRL within the time, now what we need to do? Can we file the form with payment of additional fees or we need to go for condonation of delay.

Plz solve my query, A PQR private limited company has not files their financial statements for march, 2015 to ROC till now and auditor has all ready been appointed in AGM held on 30th sep. 2014. Now company wants to remove that auditor and appoint some one else in his place for audit march 2015. can company do so?

I want to form SAUMYA MICRO FINANCE COMPANY relating to sec.8 of co.act2013 but form inc-1 was rejected by MCA in the process of name approval.however I observed that such type of many company are in existence.
