23 September 2016 Respected Sir/Madam,
My company have been paying Amount to Phonographic Performance Ltd. (Rs.100000+ Service Tax 14500). My question is whether TDs is to be deducted or not from such payment.

23 September 2016 As per My opinion the TDS would be deducted only on invoice value @ 2% u/s 194C. Please have a read - CBDT Circular No. 04/2016 dated 29 Feb 2016 wherein CBDT had opined that TDS would not be deducted u/s 194J and broadcasting rights constitute 'work'. However it is advisable to read the circular and if you fall under the persons explained in the circular , you need to deduct the same @ 2% u/s 194C

@ Joglekar Sir- Sir the payment made to PPL is for broadcasting/ music rights..
