Respected Sir/Madam,
My company have been paying Amount to Phonographic Performance Ltd. (Rs.100000+ Service Tax 14500). My question is whether TDs is to be deducted or not from such payment.

As per My opinion the TDS would be deducted only on invoice value @ 2% u/s 194C. Please have a read - CBDT Circular No. 04/2016 dated 29 Feb 2016 wherein CBDT had opined that TDS would not be deducted u/s 194J and broadcasting rights constitute 'work'. However it is advisable to read the circular and if you fall under the persons explained in the circular , you need to deduct the same @ 2% u/s 194C
