Condonanation of Delay u/s 141

15 December 2010 Dear Sir,
what is the present prpcedure of condoning delay for charges beyond 60 days form the date of event.
IS ROC has the power to condone delay up 300 days from the date of event.
Or we have to file petition to CLB for
condoning delay from 60 days to 300 days.

15 December 2010 Hi...

Form 8 for creation/modification of charge has to be filed within 30 days from the date of creation/modification, as the case may be. ROC has the power to condone the delay for a further period of 30 days only. Any further delay beyond(30+30)60 days will be condoned only by the CLB on a petition to be made in this behalf by the Company u/s 141 of the Companies Act, 1956
