After Delhi High Court judgment and stay on levy of applicable service tax on premises leased out for commercial purpose, does service tax department can still demand service tax @ 10.30% on rent from lessor in view of last month above judgment in favour of assessee.

Pls give your opinion on this.

CENVAT eligibility for Banks

Hi

The banks (both private and public sector) in the normal course of business buy certain capital equipments like centralized air conditioning plant, vehicles, ATMs etc. I would like to understand whether the banks can take CENVAT credit of excise and customs duties paid on purchase of capital items and set off against the service tax liability.

Dear Friends is recharging of prepaid mobile phones taxable service?

Can any body give any notification(s)regarding determination of taxable value.

1. I am having doubt, because anyway the cellular phone company collects the service tax on the recharge value. So whether the person running a recharge center is liable to collect service tax?

2. In case the recharge center is liable to collect service tax, Is only the margin earned subject to service tax or is the entire recharge amount to be subject to service tax again?

Dear friends please give your expert advise on this matter.

Limit of servise tax

a)below 750Rs. manufacturing co. can deduct Servise tax on transportation.if any specific limit in amt.mentation in servise tax rules pls. reply me.
b)rate of interest payble on delay payment of servise tax?
c)in transportation servise privider deduct servise tax than service receiver liability ?
D)if we receive servise below 750Rs. per bill but gross Amt.more than 750Rs. for all biil/day can we are liable service tax on such amt.

Service Tax on Freight

We are a manufacturing company. One of our customer insists us that freight amount and the service tax on freight should form part of the commercial invoice. The freight bill is sent by the transporters to us and we remit the service tax due on it to the Government.
Please advice us whether we can transfer the service tax paid by us to our customer through the commercial invoice.

E.g Format of Invoice

Re: exemption on paying service tax

dear sirs,
we are doing statutory testing of LPG cylinders(domestic house - hold cylinders),along with the painting and printing work for which we receive money from the Oil companies.Out of which we are
spending nearly 65% on above raw materials.How can we make claim on
exemption on raw materials used while paying service tax on gross amount received under the tax head Repairs and maintanence? Or will it come under tax
head works contract

Service Tax on Labour contractors

We are manufacturing co regd. under excise and producing excisable goods. We have engaged labour contractors in our factory for job work process of finished goods. They execute the work of Fabrication and Galvanizing in our factory. The job process is amount to manufacture. Contractors issues their bill of Job work on weight basis per month and they are not charging or paying service tax as the job work process of excisable goods is amount to manufacture and excise is leviable on such process which is to be paid on clearance of such finished goods processed by Contractors from factory.

My query is whether such labour contractors are covered under ambit of service tax and are liabile to pay service tax or not? If yes, under which service category it should falls?
