Service Tax Applicablity On Commercial Leasing

After Delhi High Court judgment and stay on levy of applicable service tax on premises leased out for commercial purpose, does service tax department can still demand service tax @ 10.30% on rent from lessor in view of last month above judgment in favour of assessee.

Till the outcome of the decision it is better to collect the tax. because the verdict of the court not binding on the Act
