05 August 2009 Non commercial enterprsies are outside the purview of commercial construction. Therefore first is whether the medical institutions is a philanthropic one or commercial in nature si to be decided.

05 August 2009 Thanks Madhukar N Hiregange.. But my question is about the case law regarding this....what u say is correct....same was written in circular number 80/10/2004....But i am asking for a case law on this topic...
