Can anyone advise if LIC jeevan suraksha pension plan under which monthly pension till death is given. I understand that it is taxable (pls correct if it is nontaxable) but can it be shown under salary where standard deduction is applicable or under income from other sources. Thanks

Is it right there is any lock period of 5 years for 44ADA opting assessees? Anytime an accountant can opt in and opt out this option? I have been opting 44AD for my clients who were traders since 2010-11 AY or earlier in continuous succession till 2021-22 AY. For 22-23 AY i had opted out due to a misunderstanding (all of their annual sales being below 50 lakhs -though opted 44AD there will be any taxable income ). I have reentered 44AD for 2023-24 AY for them. If filed with accounts the taxable income will be far below that which has been declared under section 44AD. Is it right to do so? But CBDT mentions 2017-18 AY as the base year for 44AD. Experts please help.

At the last moment i.e. 31-3-2023 our CA filed the ITR 2 for being salaried and having capital gains while filing the return under the old regime, there was a message for beneficial under the new regime when I asked to go for the new regime, he said that he needs to file form 10ie and it takes one day for approval before the due date and there is no time, After going home, I just listened to a video about 10ie and found that it is required only for that individual who has business and professional income and not for salaried, however, salaried must opt at the time of filing the returns and need not file 10ie. Can we file a revised return under the new regime and get a refund for what we paid under the old regime? I think there is 8000 excess we paid.

section 187. (1) Where at the time of making an assessment under section 143 or section 144 it is found that a change has occurred in the constitution of a firm, the assessment shall be made on the firm as constituted at the time of making the assessment
in light of this provision what will be the consequences of admitting new partner to the firm under following situations:
1. when itr is under processing by the dept.:
will the remuneration allowed under old partnership deed now be disallowed from return of income already filed,because of 187?
2. partner admitted in the middle of the year:
will remuneration paid or payable as per old deed upto the date of admission will be disallowed under 40(b) ?

Dear All,
Professors in Gujarat university was given Two options by the Government for the payment at the time of their retirement in 1980s.
Option 1. Either to opt for Pension Scheme or
Option 2. Eligible for Lumpsum One Time Payment at the time of retirement.
They had selected Option 2 for lumpsum One time payment at the time of retirement.
Later on at the time of retirement They approached the government to switch over for pension scheme but Government did not allowed for the same.
After that They appealed the matter in Honorable Gujarat High Court and subsequently Honorable Supreme Court and both the Honorable Court gave decision in their favour.
Now, They Have received pension from their retirement year to till date in FY 2022-23 along with interest and from Jan'23 onwards They have started receiving monthly pension.
Whether such pension received from their retirement year to till date is taxable or exempt?
Can we claim the same as commuted pension or arrears of pension and claim the same as exempt?
