Dear Sir,
We are an Exporter based in Kerala and exporting garments to South Africa,and Middle east.
We have appointed agents in these countries to procure orders and promote our products.
Against the service he provides us we agreed to pay 5 to 10% commission to the agent.and these agents are registered companies of their rspective countries like Kuwait and U.A.E.
Central excise ofiicials has asked me to pay service tax since 2006.
Would you kindly let us know whether I need to pay service tax on behalf of the Foriegn company.

We have a D.T.A. UNIT , i have a pending cenvat credit in Education cess & higher Education Cess . Can i use that credit for paying the Basic Excise Duty. if that not happen then give me any solution, How can i utilized my credit .

Please tell me

As per excise rules what is the maximum time allowed by the excise law to reach the material into the customer premises in local area

i.e. actual distance is of one hour.
but material is reaching at the spot after 10 hrs.

is it possible and will be allowed by the authorities

CENVAT query

Dear All,



We are a manufacturer of excisable goods in Haryana. We sells our finished products through the network of our authorized dealers appointed across India . Now We have got a order from one of our Gujrat Based dealer who is not registered in Excise. We have raised the invoice charging excise duty & sales tax as bill to ship to Gujrat Based dealer . Now Gujrat based dealer endorsed the invoice along with LR copy in the name of another manufacturer in transit, who is in Gujrat .



My query is , 1) Can Gujrat based manufacturer take the excise benefit on basis of our invoice along with endorsed LR copy & and commercial invoice of Gujrat based dealer ?



Please guide, is there any ruling in excise so that cenvat credit can be claimed by 2nd manufacturer received goods from non manufacture register delear on bill to ship to basis from 1st manufacturer ?



2) What will be answer if Gujrat based delear is unregistered delear?

whether any other duty of excise is also leviable on ex. goods in addition to BED and SED.If not then why there is a dipute on classificaton cases as BED and SED chargeable @ 10% rate

Pls give some practical example of person engages in prodn on his own account

cenvat credit

1 excisable m/f nae as a input koi material import kiya.as per cenvat credit rules CVD aur AED ka credit liya,aur utilise bhee kar liya. ab hum jis party k liyae kam kar rahe hain usne payment rok lee,,,wo party kahti ki aap hame import jo material kiya hai uska shipping bill dae.
to hamne unhe kaha ki uska cevat to hamne credit lae liya hai.aur uska credit unko nahi milaega.
to wo kahte hain ki us k liyae rule bataoo ki kyo hum uska credit nahi lae sakte.
mai unhe shipping bill isliye nahi dae sakta kyo ki aage sae wo phir us input ko khud import kar lenge.
plzzzzzz help ???????

MRP IN RESPECT OF PACKAGED COMMODITIES

Dear Experts,
We are sending our goods with corrugated box packing. On the packing box we also mention all details including MRP amount.
But our finish goods are not falling under MRP Rule(section 4a).
Now is there any problems from Excise and customs department for MRP sticker?
Kindly guide me.
