Why there is a need to deduct TDS in case of non- resident

04 January 2014 As they will not be filling their return or paying tax like reident assessee so as to prevent tax evasion tax is deducted at source u/s 195..

In my case an Indian Firm have to pay Commission to a company in Luxembourg then whether TDS is to be deducted and if yes than what will be the rate of TDS (as foreign company will not have Pan ) & whether concept of Threshold limit will apply

04 January 2014 Threshold limit will not apply but the rates mentioned under sec 195 shall be applicable in your case.
