09 December 2010 Dear Members,

Please advise that is there any service tax on rent paid by a company to another company in india or there is any stay by High Court or Supreme court on the same.

Please help

09 December 2010 Matter is under sub judice of Supreme court.

10 December 2010 so till then what should we do..........

Either we should deposit tax on rent & claim refund if decision in our favour or wait till dicision of Supreme court

12 December 2010 The Delhi HC opined that it is not liable and has stayed the new provision. The P&H HC has held in favour of revenue. Matter with SC not taken up.
If cusotmer pays collect and pay under protest/ Section 73A. If not take undertaking and keep dept informed. If they are issuing notice decide whether to pay on reverse charge or fight.
