19 October 2010 A.O. issued the notice for A.Y.2008-09 on 21/06/2010 ,(after the time limit)now what to do as he served one more notice to assess income u/s144
As original notice is not valid ,what to do.???
Please give some case reference for the same???

19 October 2010 Time limit is, expiry of 12 months from the end of the month in which return is furnished. If the return was submitted in or before the month of May 2009, Than notice is not valid.

Futher, If the notice was served before the last day of the period of limitation, and was served beyond the date- again it is a valid notice.

Now , you please reply whether it is valid notice or not.
