Lump sum pension received by a widow

This query is : Open

01 September 2014 My Client's husband has been a MLA and has expired after service nearly 10 years ago, my client has been receiving the family pension since then.

family pension being taxable under IOS.

can we claim exemption u/s. 10(10A) for a commuted pension received this year.

or as there is no employee and employer relationship + the husband has expired after service, will it become fully taxable under Income From Other Sources?

01 September 2014 No, it is not exempt.

Clause says any payment received by way of connotation of pension by an individual out of annuity plan of LIC from a fund set up by corporation.

There is no indication of legal heir.

Still wait for other expert's opinion.
