My wife just received her IT return (AY 2010-11) processed. Unfortunately and to my surprise, the tax has been calculated with the base slab taken as Rs. 1.6 lacs which is for male individual instead of the correct value Rs. 1.9 lacs.
What should I do?
Also I wonder how this can happen as the software program which calculates the tax should be automatically inferring my gender as female from my PAN data base; which brings to my mind, another question - how can one infer one's gender in the data base by the information printed on the PAN card?
Further, while processing the return, the gender is not picked from the database. The return is processed based on the information provided in the return.
So, if you have mentioned wrong gender in the return, the same will not be corrected while processing the return. You will have to file a rectification return.

Thanks, Mr. Siddhartha Bhardwaj; the gender entered is correct - The Intimation U/S 143(1) form clearly indicates the gender as Female. So it is mysterious how the As Computed Under Section 143(1) is based on Male. Also I think when CPC deals with millions of processing, it is an easy software fix to link the calculation with the PAN data base to get the gender correctly. Is this not the sole purpose of PAN i.e, correct information regarding an assessee.

It seems that there was an error in the tax calculation due to incorrect gender information, which affected the tax slab and the computation for your wife’s Income Tax Return (ITR) for AY 2010-11. Here’s how you can address this issue:
### Steps to Correct the Mistake
1. **Understand the Issue:** - **Tax Slab Error:** The tax slab applied is based on male individuals, while it should be based on female individuals. The difference in slabs can affect the tax calculation significantly. - **PAN Database:** The PAN card contains personal information, including gender, but errors can occur in processing due to manual or software issues.
2. **Review the ITR and Intimation:** - **Check Details:** Confirm that the intimation U/S 143(1) indeed shows the gender as female and verify other relevant details. - **Compare Tax Calculations:** Compare the tax calculations based on the correct slab (female) and the one used (male) to identify the discrepancy.
3. **File a Rectification Request:** - **Online Rectification:** Log in to the Income Tax e-filing portal. - Go to **e-File** > **Rectification**. - Choose **“Rectification Request”**. - Select the **Assessment Year** and mention the **“Nature of Rectification”** (e.g., incorrect tax calculation). - **Form Selection:** If you are rectifying a mistake related to tax computation, select the appropriate type of rectification. - For AY 2010-11, you might need to provide the correct tax details and mention the mistake regarding the gender-based tax slab. - **Upload Documents:** Attach any supporting documents or evidence that show the correct tax slab applicable.
4. **Submit a Revised Return (if applicable):** - **Prepare and File:** If you have not yet filed a revised return for that assessment year, you can do so. However, since the return for AY 2010-11 is quite old, be aware that there may be limitations or penalties for late filing. - Use **ITR-1 or ITR-2** as applicable. - Ensure that all details are correct, including gender, and submit the revised return online.
5. **Contact the Income Tax Department:** - **Seek Clarification:** Contact the CPC or your jurisdictional Assessing Officer to explain the situation and seek guidance on rectifying the issue. - **Submit Hard Copy:** If required, submit a hard copy of the rectification request or any other documents to the local IT office, if online methods are not resolving the issue.
6. **Follow Up:** - **Track Rectification Status:** Monitor the status of your rectification request or revised return submission on the e-filing portal. - **Resolution:** Wait for the IT department’s response and resolution. The department will process the rectification request and issue a refund or adjust the tax liability accordingly.
### Summary
1. **Rectification Request:** File an online rectification request to correct the tax slab based on the correct gender. 2. **Revised Return (if needed):** Consider filing a revised return if the rectification request does not resolve the issue. 3. **Contact IT Department:** Communicate with the Income Tax department for guidance and to ensure all corrections are properly processed.
### Additional Notes
- **PAN Database Errors:** PAN databases and tax software should ideally reflect accurate details, including gender. Errors can occur due to software glitches or manual entry mistakes. - **Software Adjustments:** The Income Tax department's systems should ideally link PAN data correctly to ensure accurate tax calculations. Rectifications and manual interventions help correct such issues.
Consulting with a tax professional or chartered accountant can also provide additional guidance and ensure that all corrections are properly handled.
