31 December 2009 one woman is married & salaried employee and she is living with her husband. Her husband has taken loan for their house purchase.
Now she want to claim HRA as showing rent agreement with her father.

Is this legal and can she claim this hra for her salary income for the F.Y.2009-10?

31 December 2009 In my view it is not legal, because with out paying rent and the house she is not staying ,she cannot claim, it is one type of tax avoidance only

01 January 2010 Yes i am also agree with Mr. Ramesh. It is Tax avoidance.

01 January 2010 Instead show rent paid to husband

01 January 2010 agree with CMA Ramesh

01 January 2010 better to pay rent to husband and check what would be tax out go in totality i.e. befor such arrangement and after such arrangement and decide accordingly

02 January 2010 agree with experts.
to claim full amount of HRA deduction, it's better to show rent to her husband.
