Capital gain certificate from Income tax Officer


06 October 2017 Dear Experts, Is it compulsory to have capital gain certificate from Income tax officer for deduction of TDS, in case of purchasing house property from NRI. what if a certificate for the same is obtained from CA?

06 October 2017 Any payment to an NRI is subject to TDS as per section 195 of the Income tax Act,1961 or at the rate as in DTAA. If the TDS rate is not acceptable to the NRI, the deductee can approach the Income tax officer seeking a certificate for TDS at a lower rate.

Ps:- CA cannot issue a certificate to the deductor for lower rate of TDS.
