Please advise me on the following tds issues
a) Whether surcharge is applicable: if A ltd makes payment to Ankit( individual) of Interest Rs.6 Lakhs and Commission Rs.5 lakh. Now total payment is Rs.11lakh. Whether TDS rate should be inclusive of Surcharge or only cess. i.e. 11.33% or 10.30%
b) In case, assessee deducts TDS but rate is not proper.Assessee deducts TDS at the rate of 10.3% but rate should have been 11.33%.So,now what is implication undersection 40(a)(ia).Whether expenses should be proposiontely or other wise.
Whether service tax will be levied on Fabrication and Galvanization work done by us on material provided by customer.
If yes under which category and whther any abatement is there?????

When are we liable to deduct TDS? Suppose if there was tax audit of a firm in F.Y. 2006-07 and in F.Y. 2007-08 there was no tax audit, but again in year 2008-09 there was tax audit again in the firm.Then whether the firm is liable to deduct TDS on the expenses made in year 2008-09?

Hi, can Anbody tel me whether there has been any tax liabilty u/s 194c in case there is a single bill is more than Rs. 20000/- on which liabilty is made to deduct the TDS but if in whole year amount does not exceed Rs. 50000/-
then whethet we have to deduct tds on the bills following the bill of Rs. 20000/-

please answer my query.
An unlisted public company gave an loan interest free Rs.265,000 to a director X in contravention of Section 295 during the FY 2006-07. The auditor qualified this in his report, but no action was taken by ROC.
Now this director has resigned from the company on 01.04.2009 and transferred his entire shares. During the period, he has returned only about Rs.3,000. The company is considering to write off Rs.262,000 due from him.
Is this possible? what are the procedures to be followed?
Another Director Y was given a advance for conducting the business of the company. Mr.Y has resigned from the board with some surplus money due to the company, and he also transferred his stake. Can this amount be written off as an irrecoverable debt? Is there a process to be followed?
