Rectification of mistake u/s 154

154(1) With a view to rectifying any mistake apparent from the record an income-tax authority referred to in section 116 may,—
(a) amend ANY ORDER passed by it under the provisions of this Act ;
(b) amend ANY INTIMATION OR DEEMED INTIMATION u/S 143(1)

U/s 154(7): no amendment under this section shall be made after the expiry of four years from the end of the financial year in which the ORDER sought to be amended was passed.

From the above can we conclude that there is no time limit for amending an intimation U/s143(1) because in subsection 7 there is reference to only ORDER and not an intimation.

Section 10 (48)

sir/madam plz explain the section 10 (48) of income tax?

Rahul

My agriculture land was acquired by govt and compensation was received in FY 2012-13.

The capital gain is exempt but I have to pay tax on interest component in total compensation received.

Neither I have filled any Income Tax Return for AY 2013-14 nor I have deposited any Self Assessment Tax on interest income till today as I can file my Income Tax Return till 31.03.2015 with Rs.5000/- penalty.

Now I have received a letter from Deputy Director of Income Tax (Inv) requiring me to submit to him my Income Tax Return for AY 2013-14 and other documents (like bank statements, books of accounts etc).

what are the power of deputy director (inv) in above case or what he can do????

Form 16 vs salary certificate...

Dear All,

My friends gross salary(for FY 2012-13) is more than Rs 270000/-. He had submitted Homeloane related documents to employer hence TDS has not been deducted from salary.

Now in this case should the employer issue a Form 16? Or Salary certificate on letter head?

On the other hand, employer had provided a Form 16 which
1)IS NOT in the prescribed format(just a simple document contain details about salary and deductions)
2)DOES NOT contain TAN/PAN
3)IS NOT signed by Account officer (just stamped and signed by senear officer).

The most shoking thing, the employer is state goverment.

Can you plese let know,how to submit the ITR in this case?

Please do the needful.

Direct tax c a ( final)

A non resident wins a car in a crossword puzzle and market price is Rs 240000. Tax under section 115BB @30.90%=74160.A company can recover tax from winner and release the car to winner. A company deposit tax of Rs.74160 and give a tds certificate of Rs. 74160 to the winner.

in case if tax is not recovered from the winner,then company have to bear the tax, in such case company have to pay tds
(240000+x)*30.90/100= tax
Tax = 107323
in the hands of winner income shall be 240000+107323=347323.
My questions are
1. what is logic behind grossing up?
2.Difference of 107323-74160=33163 as excess tax in case II ,why.
3. is it loss to the payee?
