Provident fund

Dear Expert

kindly advise me regarding provisions of PF act

1. Our establishment is already covered under pf act & now its paying pf to its employees but now employer wants pay Rs.7/- per employee as per the provision below

Employees' Provident Fund Scheme:

1.10% of total wages on which Provident Fund is recovered subject to a minimum of Rs. 5/- shall be payable by the employer every month . Prior to 1.8.98, w.e.f. 1.8.98 .65% of total wages
Employees' Pension Scheme Scheme:
No administrative charges are payable by the employer .The entire cost of administration is met by Central Government .
Employees' Deposit Linked Insurance Scheme:
0.01% of the total on which the Employees' Deposit Linked Insurance contributions recovered subject to a minimum of Rs. 2/- per month .
My queation are we eligiable to do so?
If then what is the procedure?

If a director is taking education loan for his own from his company, so it will attract any of the section of corporate and allied laws?
If yes then what form has to be filled/submitted with ROC?

Labour law

Dear Sir,

We have a contract with a service provider for housekeeping and that provider has provided us contractual employees (9 numbers) for the past 10 years at a monthly charge.

We now need to replace the service provider and what to give him notice.

Want to know the implications of this termination on my company from the service provider as well as the housekeeping staff in terms of Labour laws in Delhi & Gurgaon.

Companies act revised yet??

Has ICAI changed the syllabus of IPCC paper 2, Business Laws Ethics and Comm. owing to this bill relating to Companies Act?
I could not find the updated syllabus on their website nor an answer to whether the revised Act will be applicable for the nov 2013 ipce.

Applicability of revenue stamp

when the employees of the company are receiving their salary in ECS mode directly deposited to their bank account (i.e. No Cheque no Cash)
Where the company is under the obligation to use revenue stamp as per stamp act for this payments provided that the payment has exceed the limit of Rs.5,000.????

Non receipt of salary from employer

Hello All,

I have been working with a private company since Oct 2012. I worked for the company in Dec as well as Jan but have not received salary for the same yet. Earlier my MD was making excuses to make salary payment as he got involved in some Legal issues. Though he is free from all those issues now he is still not releasing employees salary.

Payment of two months salary is due. I wanted to know what actions I can take against him.

I am having company's cheque book for safety purpose wherein my dec 2012 salary's cheque is made and signed by MD. Can I deposite the cheque in bank without permission of MD? will be it under professional ethics? Or what else I can do againts him?

Please suggest
