The assessee was holding a Slum property in X area.. The BMC wanted to expand the road where the slum was situated. Hence, the BMC entered into tripatriate agreement between BMC, assessee and builder to accommodate the asseessee in one of the flat in the building in Y area being developed by the builder. The stamp duty value reported in index 2 was NIL. Thereafter, on the same date, the assessee and builder entered into repurchase agreement where the builder bought the property from assessee at a nominal value but the stamp duty value reported in index 2 forming part of repurchase agreement was 1.3 cr. The tripatriate agreement and the repurchase agreement both are entered on the same date.

How will the capital gain be computed for the assessee. Whether it will be at the stamp duty value of 1.3 cr or at the nominal amount received by the assessee from the builder?

The Karta of a HUF has expired. Please favour me by answering following :
a) Whether wife of the deceased can be Karta of the HUF for Income tax purpose ?
b) Whether New PAN of the HUF has to be applied ?
c) Whether wife of the deceased may operate the bank account of the said HUF ?

The deceased Karta left behind only his wife and a daughter (Major).

Purchase of Machinery 04.05.2017 but not installed at , installation process is running .10.05.2017 fire accured and machine destroy.
QUESTIONS
1) THIS MACHINE IS ADDED TO PART OF BLOCK OR NOT? IF YES IN WHICH SECTION
2) CAN I CLAIM INSURANCE FROM INSURER COMPANY ? BECAUSE GROUP INSURANCE POLICY TAKEN BY COMPANY.
3) INSURANCE COMPANY SAID IS NOT A PART OF BLOCK & NO PRODUCTION IS START SO THIS MACHINE IS NOT PAID ANY INSURANCE AMOUNT

I remitted more amount in TDS Challan by oversight in Quarter II. I adjusted the excess amount in III quarter. TDS return is not generated showing the error ' deducted amount is more than challan amount'. Pl suggest

UPDATED RETURN FOR THE FY 21-22

my client has filed original ITR for the FY 2021-22 within due date but skipped Capital gain income.now he want to file the ITR but time period for revised ITR is over, so shall I file updated ITR for that income in January 2023 ?
can any one guide me in that matter

Section 54 : Residential Plot Sale

I reside in a jointly owned residential house A with my brothers, where I barely have a room to live. All of them have multiple rooms.

3 months back, i sold a jointly owned residential plot B (with my brothers).

Now, i want to buy a flat/ apartment C to reside.

Can I claim capital gain exemption under sec 54 with respect to B & C.

If yes, can i use sale proceeds from B elsewhere & use a home loan instead for C?

Circular 23/2017 dt 19.7.17 clarifies that TDS should be deducted on amount excluding GST, provided GST is indicated separately. Now, under Income Tax act, for what purpose should this circular be applied.

1. For the purpose of ‘determining the amount’ on which TDS should be calculation .

2. For the purpose of ‘determining TDS APPLICABILITY’ ie: scope of TDS threshold limits.

If the scope of the above circular be applied on point no 1 , then what is the scope of checking threshold limits(including GST or excluding ).

ITR U FOR THE ASST YEAR 2022-23

Assessee's Total income for the financial 2021-22 is Rs.472800. After 87A relief his tax is zer0. 234F Rs.1000 Payable. He wants to file ITR U for the asst year 2022-23. He has not filed return already. Is it possible . If it is possible challan 140B or 140A. How much is the tax payable. His age is 58 years.

History-
I paid monthly contribution ( about 12%) from my tax paid salary to my Company regularly for 14 year ( about Rs. 9 Lakhs)
After retirement at 60 years , Company fixed my monthly Annuity through SBILIFE and I am receiving annuity monthly .
Question -
This annuity is taxable or not ?
In my opinion , it should not be taxable as I had contributed this Rs. 9 Lakh fund from my taxable salary for past 14 years. Can we connect this case with Section 10 , Tax clause 23aab
Kindly clarify me .

INCOME TAX BACK DATED RETURN

Note that PARTY Not Filed any Return in Previous Year , he is a salary holder
Please said us can we will filed BACK DATED Income Tax return for 03 Years (i.e. A.Y 20-21,A.Y.21-22,A.Y.22-23 ) IF YES THEN PROCIDURE
