Sir,
if there is a FD for a long term then what is the treatment 4 matured amount in curret nd DTC... If any special treatment then what is long term period for FDs....

Will maturity amt of a long term FD consider as capital gain...

capital gain tax

i am holding tanancy property since 1996.
in 2008 same been surendered to builder and in lieu of such transfer I havebeen alottted a ownership shop.in 2009 such property gifted to my sister in law wit proper gift deed excuted and duly stamped.

1] whether any capital gain will be attracted on allotment of such .
2) whether any gift tax will be attrected.

TDS deduction

1) We have a Contract for Operation & Maintenance of Telephone and PA system network at plant site & staff colony of our organization.
Workers are engaged in this contract are not professionally qualified but having experience in the area of telephone and PA system. My question is under which section of TDS is deducted 194 C or 194 I.

2)In a running contract TDS was deducted and deposited in 194(C) instead of 194(J).
This is happen last financial year and in this year also.
my question is what is the remedy? Still this is running for next 3 month also.

Individual ITR filing

A person is doing the business of agriculture in his capacity as proprietor during the year. He has not generated any income till date but incurred expenses. He has not filed the ITR as on 31st MArch, 2011. Is he required to do so, and if not whether the loss can be carried forward.

A company engaged in agricultural business want to acquire the business from the proprietor. For that they would enter into an agreement for acquisition. Is this procedure correct . Is there any problem if the proprietor has not filed his ITR for the year.

Can anybody please provide the format for such an acquisition agreement.

The tax on Dividend Distributed (DDT) by the company is to be paid u/s 115-O within 14 days from the date of
(a)declaration of any dievidend; or
(b)distribution of any dividend; or
(c)payment of any dividend. which ever is earlier.

Normally the dividend for the year ending March is declared only in the AGM which will take place in the subsequent financial year.

For eg. the books of accounts are closed for the year ending 31.3.2011. The dividend would be declared in the AGM say conducted in June 2011.

Now the question is What is the AY which the DDT has to be paid?

Is it AY 2012-13 since the trigerring point for the DDT would the financial year in which the dividend is declared which in the instant case is FY 2011-12.

or is it AY 2011-12 as the dividend relates to the closure of books and declared out of accumulated profits for the year ending 2011.

The details of DDT has also be filed in the ITR and if the wrong AY is being incorporated it triggers the demand while 143(1) is being generated.

a govt compnay is acting as implementing agency 4 govt in an infrastructure proj of govt.the co: has acquired land,constructed buildins nd other ativities in proj area.howevr it has kept the accounts of infrastructure project seperately and its unaudited for past 15 yrs.
nw it has sold tis proj land to a joint venture co: under a g.o.tis govt co: has 26% shareholding in joint venture co as per tis g.o.the lease premium is adjusted against tis shares and tds dedcuted wit govt co: PAN.
the lease premium cums 2 6.5 crores.nw govt co: dus not want 2 show tis incum in books due to tax prob.suggest a solution since shares r issued in the name of tis govt co:both the investment and incum needs to be off-financial statements
