Chargeability of capital gain

An assessee made an agreement with a property dealer on 25/04/2009 against purchase of a flat and the following payments were made during the Flat was under construction period :
F.Y - 2009 -10 - Rs 2726800
F.Y - 2010 - 11- Rs 2722892
F.Y - 2012 - 13- Rs 456182
Sold the Flat on 28/05/2012 without taking any possession of the flat .
Kindly advise us whether indexation benefit will be available or not ,if the amount is charged as LTCG ? how the payment made in F.Y 10-11 & 12 - 13 is to be treated ?

Agriculture land

An assesse's mother sold a agricultural land for cash & had received & deposited such money in installments in her bank account. Now, she wants to gift such cash sale proceeds of agricultural land to her son (assesse) for which she ready to undersign a gift deed.

So, my question is CAN SUCH GIFT BE ACCEPTED & SUCH SUM OF Rs. 30,00,000/- approx. be transfered from assesse's mother's bank account. Also, can he take gift such a huge amount.

IF YES, WHAT WILL BE THE DOCUMENTS REQUIRED TO BE GATHHER & MAINTAIN BY THE ASSESSE FOR PROVING THE GENUINESS OF SUCH TRANSACTION.

Further, is it required by the assessee to prove the genuiness of the gift from the donor .i.e. his mother??

Respected Sir, Can you Please tell which land will be said to be sold under rural area???

Tds late payment

Hi
Please clarify my doubt regarding TDS late payment I forgot to pay last year June month TDS. Now the party is asking form 16A. can I pay the TDS this fiscal year. If its, what shall I do for late payment interest and e-tds filing?

Wrong assessment year in chalan

while making self asax due for last yeasesment Tax chalan for assessment year 2012-13 i wote 2011-12 as assessment date. how do i correct it now?? I learnt we have to contact AO?? but how.. through mail or personal letter??? please let me know.. and how do we identify the AO's email id or address

what is the method & rate of capital gains tax on ZCB,debentures,units other than equity oriented fund if these are:
1.unlisted
2not sold thru recognised stock exchange(rse)
3.sold thru rse?

I have filled my Income tax Return for AY 11-12 on 16.08.2011 have a refund of rs 20540 and also send my ITR V copy to Banglore but it is not recived by them and now 120 days are over and now the officer of the department told that i hav to file the return once again my reutrn mannual and have to submite at local income tax office and my orginal return has no validity and it is cancel. and my income tax word is of u.p as per my pan data and right now i am doing job at ahmedabad so it is nt possible for me to go there for filling retrun ..

so please gudie me now what to do wheather i filled my return mannual or anyother option available !!!

Distress sale of immovable property

I made a distress sale.

I entered into an Agreement Of Sale (Sathekhat) for selling a plot of land for Rs.10,00,000. The Agreement Of Sale has not been registered. The person with whom the agreement was signed also took a Power of Attorney from me since he will be selling the plot at a later date. The Agreement Of Sale was signed so that he could pay me the agreement amount of Rs.10,00,000 through a cheque.

Now, how do I pay income tax on the sale. There wont be a sale deed until the person actually sells the land to someone else. However, I have received the agreement value in full and deposited it in my bank account. Can the capital gains tax be calculated on the amount in the Agreement To Sale since that is the amount that I have actually received or do I have to wait until the plot is sold via a proper sale deed.

In case there is a query from the income tax dept. will the Agreement Of Sale be enough proof to show the source of income. If not, what do I do? Will registering the Agreement Of Sale help.
