Captive Consumption

Where any unit is producing excisable intermediate product all of which is being used (Captively Consumed) in manufacture of excisable finished goods within the same factory, what will be treatment of intermediate product for excise purpose? Will the assessee be required to maintain captive consumption invoices? Also tell if benefit of notification no. 67/95 will be available to assessee or not? If available then intermediate products are exempt then also will the assessee be required to issue invoices for material captively consumed(which is exempted as per notification)?

Registration under Central Excise

12.10.2009

To All Members

My client is a manufacturer of leather bag and present turnover is 98 lacs (95 lacs export sales and 3 lacs local sales) and it is an SSI Unit.
1)What is the limit amount to get registration under Central Excise in case of an SSI Unit?
2)Is the "Labour Charges Received" include in the turnover of Mfg.sales at the time to judge the limit for registration?
Example: Mfg export sales 1.45Crore+ Local Sales 4 lacs+ Labour Charge Recd Rs.10 Lacs=Total Rs 1.59Crore. Then will this SSI unit company will get registration under the C.Excise Act.

Cenvat Credit

The company has purchased the machinery under EPCG scheme in Baddi (Having excise exemption)during previous year. Since the company was likely not to complete the export obligation, the company paid the saved custom duty and excise duty on the said machinery.
Now the company decided to sale the said machinery to some other party registered under Excise.
Now my question is whether the company can pass on the excise credit paid on the said machinery to the buyer and can the buyer can availed the cenvat credit?
Its Urgent.
Provide judicial pronouncement backing your opinion.
Thanking You,
Mihir Gandhi
