Utilization of credit under reverse charge mechanism

Can cenvat credit be utilized,
1. If ST is paid to service authority,say 12.36
2. Only invoice is booked and not paid to vendor. say 100

If it is under partial reverse charge and the vendor is one time i and did not pay him the amount, can still be cenvat utilised ?

The amount deposited to government is 50% and I utilised the credit, not paid to vendor. Still can I claim ?
