Tds on foreign remmitance

My client is making payment towards professional consultancy to service provider in Netherlands, the service provider does not have PAN , what is the rate of TDS to be deducted whether 20% or 10 % as per DTAA.

15 July 2015 It is 10% as per DTAA as per the recent decision of Pune Bench of the income tax appellate tribunal.

Also guide me in one case by oversight TDS return of Salary for 2nd QTr F.Y 2014-15 was not filed, i need to file the same now, late filing fees is calculated to 55000/-, what steps should be taken.

15 July 2015 How much is the TDS amount for that quarter the late filing fess is restricted to TDS amount.
