15 September 2011 Suppose TDS is not deducted on any payment but the payee has offered the sum for tax in his return of income and has deposited his tax liability. Whether in this case the payer can claim deduction of such genuine expenses looking the legislature spirit behind TDS provisions.

21 September 2011 If the expenses are those covered in Section 40(a)(i) or 40(a)(ia) then the expenses will not be allowed as deduction irrespective of the fact that the payee has offered the income for tax.
