Taxability of family pension

17 June 2013 If husband receive family pension after the death of his wife, whether he can claim the deduction of 15000 or 1/3rd.

17 June 2013 yes he claim that u/s 57

17 June 2013 As per provisions
It is taxable in the hands of recipients under section 56 under the head “income from other sources”. Standard deduction is available under section 57 which is 1/3 of such pension or Rs. 15000, whichever is lower.

So yes he can claim deductions.... :)

17 June 2013 But you can see in the section 57, his is written & also the definition of family include widow, children & parents.

17 June 2013 Family pension received by any family members, so family members includes spouse. so it is allowed as experts advice, there no genderwise different applicability in the section even though it mentioned in the section as "his"
