12 June 2009 Is service tax is exempt on construction of Roads. Please let me clear it is exempt on Govt. contract or all type of contracts. Please reply me on satendra77@yahoo.co.in

12 June 2009 Construct of Road is excluded from the definition of Commercial & Industrial Construction Service.

It is exempt whether awarded by the Government or otherwise.

12 June 2009 Thanks for your reply but in my case the situation is that we have taken on esingle contract for Industrial Construction Service and out of this we have given seprate contract for road to sub contractor. So whether he should charge service tax from us or not because we are charging tax on whole contract.

17 June 2009 The sub contractor would not be required to charge since he is doing the construction of road whic is excluded both from commercial constreuction as well as works contract catgeory.
