Search and seizure damages

29 November 2011 I wanted to ask that suppose If an assessee under income tax or wealth tax had a search and seizure conducted on his premises and during the search there were no evidence found and everything was in order all the laws are complied with by assessee and if during such search several locks or several damages occur on the property due to income tax search officer than are there any provisions for recovery of those damages or the assessee has to file a case in court against department???

I also want to know the same about if an assessee due to search and seizure lost some mazor deal or business going on.. than what???

30 November 2011 As far as income tax act is concerned . There is a provision which put an obligation on tax officer to carry out the search proceeding in discipline manner. There is no provision for refund of loss made by the assessee...consult lawyer to help u out on this..I believe there shud b solutions for this with lawyer
