12 March 2013 In articles of Association of the company it is specifically mentioned that section 171 to 186 are not applicable for the company.

So for EOGM can i give shorter notice than 21 days.

Please solve my query.

12 March 2013 A company cannot curtail by its AOA the 21 days notice required to be given under the act.

12 March 2013 Agree with Warrier Sir....

I think, in your articles it will be in reference to Shorter notice for calling of AGM.

As per section 9 of the Companies Act, 1956 MOA & AOA can not over ride Companies Act, 1956.
