Regarding e-1 sale , material sent by hand

18 July 2014 we have recd a order from "A",as per instruction of"A" we have sent material by hand to "B".

Actually this a E-1 sale but have no LR as material sent by . can we get claim under section 6(2). As per this section title of the document should be transfer as the time of movement of goods . but have delivered the material by "B".Hence not title had transferred in this case

Kindly suggest.

19 July 2014 For E-1 sale, title must be transferred when material in transit, and for the same proper documents are needed.
as told by you, it was already decided that material is to be deliver to B as per instruction of A, so in my opinion this falls in section 3(a), and not in sec 3(b).

Cany u pls guide me what we have to bear the pealty is this case.
As per MP tax site we can issue the E- withiout mentioning LR No. . can it be accepectable by the customer
