IN CASE OF PF/ESI PAID ON OR BEFORE DUE DATE OF FILING OF INCOME TAX RETURN UNDER SECTION 139(1), THEN SUCH EXPENSE ALLOWED AS DEDUCTION UNDER PROFIT AND LOSS? IS THERE ANY CASE STUDY ON SUCH MATTER?

Such delayed remittance before filling return not allowed as per legal provisions and confirmed in the following Apex court case law.
Hon’ble Supreme Court in the case of “Checkmate Services Private Limited vs. CIT in Civil Appeal No. 2833 of 2016 dated 12.10.2022” has decided this issue against the Assessee.
