treatment of income tax penalty paid by employer U/h salary

Your query is not very clear.
What i have understood is that the employer has paid the income tax penalty on behalf of the employee.
If this is the case then I am of the view that this will constitute a perquisite u/s 17(2)(iv) since it is a sum paid by employer in respect of an obligation which but for such payment would have been payable by the employee.
