Hra claiming u/s 10(13a) of the income tax act,

10 November 2012 Resected Experts,
I just want to be get clarified w.r.t HRA exemption.
Suppose if i pay Rs.10000 per month as rent, he says only Rs.5500 is for rent, the balance are for amenities such as electricity, water, bed, television etc. Can i claim HRA for the entire 10000 or just for 5500. I need this clarification very urgent.

11 November 2012 Rent meaning for HRA claim not given in the act. but as per Rent definition u/s.194I of of the act Rent includes any building and furniture & machinery. so what ever the amenties like electricity, water,bed etc. will not form part of the rent.

So my view only Rs.5500/- will eligible as Rent for claiming HRA

11 November 2012 Further, for specified employees amenities as mentioned here in above are taxable perquisites, so in no case the amount of Balance Rs 4500/- will be considered as part of HRA.
