GST on sale of old Medical Equipments

This query is : Resolved

Quick Summary
This discussion addresses whether a nursing home with GST registration is liable for GST on the sale of old medical equipment like X-ray and ECG machines. The consensus leans towards GST being applicable, particularly if Input Tax Credit (ITC) was claimed on the original purchase. Even if ITC wasn't claimed, the sale might still be considered a supply under GST law, with tax potentially calculated on the transaction value or ITC reversal.

02 March 2022 Dear Sir,
We are running a nurshing home and have taken GST registration due to rental income. We have sold old Medical machines X Ray and ECG Machines upto WDV will we be liable to GST. If not kindly mention the exemption notification

03 March 2022 Not liable for GST as sale value less than wdv.

03 March 2022 Sir can you mention the section or notificaition as i am aware off the notification 8/2018 dealing with margin is applicable for old vehicle, kinldy quote the notificaiton or section.

03 March 2022 As per my Knowledge you will be liable to Pay GST on the Transaction Value of Goods sold at the applicable rate of goods

03 March 2022 If ITC have been claimed against the purchase of Machines then pay the tax as per Section 18 (6) of CGST Act.

03 March 2022 Sorry to Defer to Mam,
But even if ITC is not claimed on the Purchases, same would be considered as Supply under GST Act.
If ITC is Taken the Calculation will be Higher of ITC Reversal or GST on Transaction Value
