Exemption from TDS

26 April 2010 Dear experts

We are paying brokerage to XYZ person for getting rented guest house. The amount of commission is Rs 45000/- & the broker is saying that he is having only the above metioned income & asking to dont deduct a TDS. Also he is not having PAN. So my querry is can we pay him without deducting any TDS amount? If yes, is there any form available like 15g, 15h?

Please help me out.

26 April 2010 PLEASE MENTION THE DATE OF SUCH TRANSACTION.

26 April 2010 Brokerage need to be deduct under sec.194H (thereshole limit is Rs.2500) and if he want no deduction, he need to apply to the A.O.with form 13 for tds exemption certificate
