24 July 2012 Sir ,

If I am dealer in chemicals business in mumbai , I already pur material from hyderabad with basic rate + excise + cst 2% & now i want to sale it to my customer (in mumbai only ) on sale in transit basis.But prob is that , i am reg under excise & party from whom i pur prepare gate pass in my name.
so i want to ask you that can i prepare my excise gate pass to my customer name & commercial invoice in sale in transit basis.

Reply as early as possible. If i thankfull to you if you can provide my section reference under which it is said this

25 July 2012 If u r a dealer registered under central excise as 'registered dealer' then u can issue your excise/commercial invoice in customers name even in respect of sale in transit, there appears to be no problem.

If dealer"A"(mumbai) purchased from manufacture B (huderabad) . Now at the time when mateiral in transit A sold the material to C in gujarat as Sale in Transit / E-1 transaction.
now my question is if Manufacture issue excise gate padd in the name of A , then can a issue excise gate pass to C & issue commercial bill as Sale in Transit to C .

AS in excise if u want to do sale in transit then manufacture have to prepare gate pass with additional info that buyer is A & consignee is C & it will be before the commencement of transaction.
