Educational Institute- liable to service tax?

18 February 2010 My client has rented out commercial space to an educational institute( Prometric). Do i have to charge service tax on the renting service or Prometric being an educational institute its exempted from the same?

19 February 2010 As long as the institute is not one which is covered under commercial coaching and training defintion, you need not charge.
The service of renting itself is in doubt and presently before the SC on grounds that there is s\no service in pure renting. You may examine that aspect also.
