17 October 2012 i) If possession and control rests with the lessee , it is 'right to use' which attracts VAT and hence no ST liability. Therefore, you have to check your state VAT law to ascertain VAT liability.

ii) If possession rests with the lessor, service tax attracts @ 12.36% and hence no VAT.
