02 February 2009 Cir No. 108/02/2009-ST dt 29/01/09. No Service tax on contract between Builder & Buyer of residential flat VAT Cir-6 dtd. 30/01 Fresh/Revised VAT be e-return. so any one suggest me which tax is appicable for this its urgent plz solve my Q.

02 February 2009 The Circular is again debatable because the last sentence of para 3 is the deciding factor. Moreover the circular has come for Construction of Complex covered under 65(105)(zzzh). But the circular is silent about its implications on works contract services under 65(105)(zzzza)which is applicable to flat construction also. In view of this I can't give a definite answer to you query. Views of learned memberss are invited.
