Can we take cenvat credit

If the service is taxable and service provider is also have S.T registeration no.....but S.T has not been charged in bill....can we take service tax credit by gross up the total bill amount????? plz reply me soon....

No deemed ST payment credit is available. The ST has to be charged specifically in the invoice along with the type of service and clear ST number and then only credit can be availed.

m not satisfied........ST has not been charged specifically in bank charges but we are taking cenvat benifite....so like that can we take credit.

If the bank is showing only charges and bank's charges are incl of ST then you have to reversely calculate the ST on it and claim the charges exclusive of ST and claim the ST seperately but if the charges are exclusive of ST then you can't claim cenvet credit of the ST if it is not been charged to you specifically.
