can i file a tax audit return file now, as there was a problem in the digital signature, for which it was delayed beyond limit. this is for the AY 12-13.

Yes. you can file a belated return

There will not be any penalty if such return is furnishe before the end of the relevant assessment year i.e 31/03/2013.
However, interest u/s 234A will be chargeable if the tax is due for payment.
