TDS on Salary is deductible on payment basis and not on accrual basis. A co. has not paid salary to its employees due to financial problems.Not deducted TDS. Provision has been made for salary payable.The employee filed return offering salary receivable from co and paid tax himself. In next year co paid the salary dues to employee. Is there any need to deduct TDS by co on payment of salary for which tax is paid by employee? How employee would get tds credit? Would not it be ridiculous or meaningless on part of the co to deduct tds now on payment basis? If co does not deduct tds on payment basis, as auditors what comment to write in 3cd clause? Early solution solicited. Thanks.

One of my client had a agricultural land with joint ownership of 5 brothers & 3 sisters located in village Jamiyatpura within 14Kms range from Municipal Corporation or cantonment board area of Ahmedabad & having population of the village is nearly 2000 persons.
This land is subsequently acquired by Gujarat Govt in F.Y.2013-14 & given consideration to all joint owners separately and deducting TDS as per I.T.Rule.
Now query is whether such land can be considered as agricultural land in rural ares hence not considered as capital asset within meaning of section 2(47) of I.T.Act ,therefore whatever gain on sale of the same is not subject to long term capital gain tax.

CASE-I:- If I have taken loan for the construction of house property on 01-04-2011 and construction of house is completed on 05-07-2013, but loan is fully repaid on 10-10-2011 (within one year of loan taken).
Then in this case whether there is any pre-acquisition period whose deductions of intt. i will be getting in FIVE equal instalments starting from the F.Y.2013-2014.
CASE-II:- This case is quite similar to above, but in this case if the house is constructed completely within one year of loan taken but loan is unpaid then also I have to consider pre-acquisition period or just I have to consider intt. for the year 2013-14 for deduction.

I received a letter dated 9/4/2014 of provisional admission to CA final may 14 exams stating my roll number as well. It mentions that as per my exam form i m serving last 6 months of training and that if any revalidation is required we need to apply for it. Since I registered for ca final in 2012 so revalidation not needed.. But yes 30 months are not completed as on 1.5.14 . I agreee to that. But what to do now of this letter? I will go to d regional office,but wan to know what I m expected to do
