Mr. X's daughter got married in Nov. 2012. She received cash gifts worth Rs. 15 Lakh which she did not deposit in bank. Now in February Mr. X is planning to buy a life insurance policy for which he wants to utilize that cash of Rs. 15 Lakhs (Which the bank has agreed to take in cash)for policy premium. Now the question is how should Mr. X show this:
a. Either he can show that his daughter gave him gift through cheque (which will be exempt being relative and then he can buy the policy himself.
b. Other option is his daughter can propose a policy for Mr. X. In this case the gift-to-father transaction will get eliminated.
I want to ask which option is safe.
And whether AO can ask that why she did not deposit the money in bank for 4 months.
Or any other problem which can arire in these transactions. Please reply ASAP.

Sir,
Our unit is availing exemption under notification no 50/2003-CE from the whole of the duty of excise or additional duty of excise in Dehradun and we are manufacturer of Read Made Garments. we are sending the goods for WASHING purpose to a unit who is also availing the exemption of 50/2003, means in the same area.
Service tax is exempted for manufacturer of Excise-able Goods.
Now the question is, washing process is amount to "Manufacture" or not and Service Tax is applicable or not. Please guide for the same.

Hi all,
I have some issues regarding Partnership firm
audit and filing. As one of my client started
one partnership firm and in partnership deed clearly mentioned capital of firm is Rs.5 lakhs which will contribute by all partners equally. But partners contributed only Rs.2 lakhs. Is this have any conflict under income tax act or as per partnership act?. if yes, what is that?
Again in the same deed mentioned that Rs.5000 p.m is payable to working partners, as there are 2 working partners in the firm. Firm has not paid the salary to working partners as there is no income to firm.
1.Now can the firm claim this salary as expenses?.
2. what is the tax implications from partners point of view if already filed the return?
Thanks in advance
Whether esi & pf is applicable on contract labour... Also if applicable whether both employer & employees contribution is to be made....
There is a agreement between our company and another company. when we make payment to that company we usually deduct TDS as per Section 194C. this year we filed a case against that company for some matter and the order was passed against us. Now we have to pay an amount to that company as per court verdict. shall i deduct tds on this payment.
Please advise me.

A husband wants to transfer a portion of his shares held in a private company to his wife. Following are some of my queries :-
1) Should the shares be transferred at face value, i.e. Rs 10/- or at book value i.e. Rs 850/-.
2) What forms are to be filed w.r.t. such transfer?
3) Taxability implication on the transferor, i.e. husband.
4) Taxability implication on the transferee, i.e. wife.
