Tax audit

There is a Airline Travels Company who purchases tickets for resale on which it receives Agency Commission.
If Commission earned is 30,00,000/-
Whether Tax Audit is applicable to the company??

A person provides labor bill of rs. 1,00,000/- and service tax on it is rs. 12360/- total bill amt. 1,12,360/- pl inform me whether to deduct tds only on rs. 1,00,000/- or as th bill is inclusive of service tax; no TDS would be deducted?

Income tax tds notice not clear

Hello Experts.
My client is a Bank and has recd. a notice of defaults in TDS payments after we filed his correction statement.
In earlier correction statement we had inserted some PANs in Pan not Avbl. entries on which Bank had deducted 20% in some entries only. Further, in some entries wrong PAN was quoted & this was also corrected by us. Naturally in the cases of wrong PAN quoted bank had deducted tds @ 10% instead of 20% believing that the PANs were correct.

Now Income tax deptt. demands TDS @ 20% in cases where PAN was not avbl earlier and less than 20% was deducted which we believe is correct though we had inserted PAN in correction but the liability was of 20%.

The confusion is that even after correction the wrong PAN quoted on which 10% TDS was deducted still ITD is asking for 20% on it in it's Justification Report. However in some such entries ITD is satisfied stopped demanding 20%. The picture is not clear as in some entries they are demanding 20% in some others they have closed it, though we followed the same treatment of quoting correct PANs in all such entries.
Is deptt.'s contention correct?

Income tax capital gain

if a husband and wife have residential flat in 1/2 share in their name husband name is first and second name of wife they want to purchase another flat in 1/2 share and this time first name is of wife and second name of husband then what will be effect of capital gain at time of selling any one residential flat can they invest in another residential flat for exemption from capital gain tax or have to invest in capital gain bond will both be having capital gain tax our only the person with first name pl explain in brief

Digital signature on form16a

Please let me why now digital signature option is not coming at the time of conversion of text file into PDF . Upto 2 qtrs TRACE was giving facility of Dig. Sig. Now what happened? May be I'm doing something wrong. Please solve my query.

Capital gain exemption u/s 54

Dear sirs
the assessee has sold a property 4 years ago, and invested the proceedds in anotherr residential project to de developed by a vwery big builder. There are many residential property to be constructed in that project. The said assess has entere int an agreement to purchase 1 property and also paid consideration for that plot..
the constrructions is not completed and handing over of possession is also not given..
my question is whether such agreement to purchase considered as investment under section 54 and will it be exempt...

pls help us soon

Mr A. Sold shares in AY 2002-03, and incurred lonf term capital loss of Rs 50,000. AY 09-10, Mr A sold a property and earned a long term capital gain of Rs 1,00,000.

Can the loss of AY 2002-03 can be set-off against long term capital gain in AY 09-10 as during AY 02-03, the section 10(38) was not in existence. i.e it came into effect only from 01/10/2004. Hence Long Term capital loss on shares were allowed to be carried forward and sett off against other long term capital gain.

Sir ,

I was registered for articleship on17th april 2013 then i took transfer from that firm and joined in another firm after 3 days.
During in the first firm there were 8 leaves .
Am I eligible for Nov 2015 final exams???

Defective return

the assesse has filed his IT return for A.Y 12-13 u/s 139(4) i.e after due date. He has tax payable of rs.3000..but bymistakenly he forget to enter tax payment details..and uploaded as payable...can he rectify this mistake now ? and is this a defective return ? what is the procedure ?
