Valuation of property

one of my client received ancestral property under partition on 15th Dec 2012 as per record of rights. Assessee sold the same property on 10th March 2013. 1. Whether it is a short term capital gain or long term capital gain 2. How to take the cost of acquisition. 3. cost of the previous owner is 100 years old property. 4. whether to take value as on 1 4 1981 5. Whether cost Index is applicable 6. How to calculate profit on sale of the property. Please clarify 3. value of the previous owner

Excess tds paid by deductor

Dear Members
X Co. Ltd. paid TDS on Director's Salary Rs. 5,00,000. But after correcting errors it was payable only Rs. 2,00,000.
How to claim Rs. 3,00,000 refund by company? Kindly give me full details about this process.

Service tax under rcm on cab hiring

Dear All, I want to ask that in under RCM method on CAB hiring service receiver needs to pay tax by two method one is 40% of total liability if provider is not claiming abatement and 100% of total liability if service provider is claiming abatement. Now the issue is if provider is not charging any thing on invoice or if he his unregistered cab provider in that case how much receiver needs to.pay whether full 12.36% or 4.94%. Please justified with full clarification don't copy paste the notification.

friends can u pls tell me whether a company can take credit for service tax paid on installation charges charged by seller of ups when paid on purchase of UPS(capital) or it will include in the cost of product.

Life insurance premium paid by father

Hello,

If father pays the premium of Life Insurance (Rs. 75000) of her daughter who is not dependent on him, then whether the daughter can claim deduction under section 80 C of premium paid by his father?

House property

sir,
For the financial year 2012-13 the house property was vacant for the whole year (the property is other than self occupied property)but municipal taxes was paid for the property whether the municipal tax paid can be shown as expense for such property.

gross annual value 0
less: municipal tax (5000)
------
net annual value -5000
less: deduction u/s 24
1. 30% standard deduction 0
2. int on borrowed capital 0
-----
loss from house property -5000
-----

can be claimed or not

I have heard that IGNOU have tie up with ICAI so that CA students can complete there B.COM along with CA in a short period of time just by giving some papers ( not all).

Itr form sellection

dear sir

I have since last two years business income so I file my return by filling ITR-4

but this year I have no business income.
I have only interest and rent income during FY 2012-13

Now I want to file ITR-2 now

Please advice me that is there is any legal obligation during chageof ITR form for filing of return ??

One of my friend (pension holder)filed his tax return along with his co pensioners for the assessment year 2013-14 in the month June 2013,without showing his agricultural income, dividend income and S.B. interest income.But the assessment is completed in the month December 2013 and order was passed only for pension income. Now he decided to declare ag. income in assessment year 2013-14. Is it possible to file fresh return in this A.Y. 2013-14.
