service tax on lottery commission

hi

Is commission/ profit on sale of lottery by a whole sale lottery distributor is subject to service tax? If so what is the taxable service?

set off against excise

hi,
we r in the manufacturing of excisable goods known as industrial valves. we take the cenvat redit for our input on the basis of raw material. can we take the service tax set off against the excise payalbe. we are paying the bill amount inclusing the service tax for testing charges and the telephone charges. is it allowalbe to take set off of the same

We have import a machine; We have paid Insurance and Clearing & Forwarding Chages thereon. These charges includes Service Tax

Can We take Service tax Input credit regarding above charges ?

If Yes, Can It claim in same year or 50% in same year & 50% in next year ?


I am bit confuse because according to definition of "Service tax input Credit" in the case of Maufacture; Service tax credit is available only when services is related to direcetly & indirectly Production
But above said services are related to clearinf & Forwarding of Machinery not Raw Material or Production

Please give me proper suggestion

Clearing & Forwarding Agent Services

Fact : Assesse has been providing Clearing & Forwarding Agent Services to a Manufacturing company and earning commission on total sale month wise and at the rate mutually agreed upon. Assesse is also entitle for the incentives if certain condition satisfied ( surplus sale then agreed upon) as per one of the clauses of the agreement.

Query : Whether assesse is liable to pay service tax on the amount received other than commission amount mutually agreed upon i.e.incentives. Kindly quote the relevant judgement if any you have.

Dear sir,
i just want to know that can i carry forward Serive tax liabilities like that service tax cenvet credit.
example
i have first month 100/- liabilities of serive tax in that month i have 90/- cenvet credit
in next month i have 90/-liabilities of serive tax in that month i have 100/- cenvet credit
in that situation can i 10/- service tax liablilites of first month use of second month of excess cenvet credit ..........

Cenvat Credit on Outward Freight

We are manufacture in Nasik & our price of goods/material is upto to Customers gate.

In this case whether we are liable take a credit Service Tax paid on outward freight charges upto to Customers gate ?

Renting Of Immovable Property

Dear Management,


Fact : Assesse has been engaged in output service as well as manufacturing activity since last many years . Being an Out put service provider (Technical Testing And Analysis )assesse has availed crdit on services namely (Renting Of Immvable Property ) bills.
Question : assesse has been providing service of Technical Testing And Analysis from the premises, which assesse has obtained on rent ,whether credit of service tax paid on renting bills available to assesse as input service?

service provider provides both exempted and taxable output service and does not maintain seperate accounts.

out put service tax is Rs.20000
Input service tax is Rs.16000

How much tax is to be paid?
How much credit will the assessee get?

If whole credit of Rs.16000 is not available then whether the balance credit amount lapse?
