10 July 2008 We are manufacture in Nasik & our price of goods/material is upto to Customers gate.

In this case whether we are liable take a credit Service Tax paid on outward freight charges upto to Customers gate ?

10 July 2008 Dear Satish

This is a metter of dispute since long. However in Aug 07, Department has issued procedural clarification circular No 97 in which it is clared that in case of FOR despatches cenvat credit shall be allowed. This circular is still alive even after some change in input definition in current Budget. In my opinion, cenvat credit will be available and many companies are doing it. You can refer circular for more clarification.
