Cenvat Credit

If a ferro alloy manufacturer, who uses electric arc furnace, takes huge credit on copper bar presumably for manufacture of copper contact clamps for the furnace & if he has no such arrangement for moulding copper bar into contact clamps and gets it done from somewhere else without informing the department, what are the offences? Is the Cenvat credit on copper bar, already availed, is recoverable from him?

Excess service tax paid

Can excess service tax paid on transportation services (25% of value) be taken as excise credit?
or otherwise it can be adjested i.e.less paid for the next month?

let out of excise regiereted premises

A ltd. a company dealing in petrochemicals, registered as MFR in central excise and he wants to let out 2 storage tank out of his 20 tanks of factory to other dealer.

1. Can we do so? if yes , then whether we have to take permission from central excise ( something like NOC)---please give relevant sec. ( if any)

2. What is procedure for tenant?

Clearance of input as such

Will any one help me by throwing light on what is the rules and regulations for clearing of inputs as such by a manufacturer from his premise.
1. Which rules Central Excise is relevant.
2. What are the latest, notification, circulars.
3. Can the price of the input while clearing as such be higher than the original price of procuring by the manufacturer?
4. If yes, then what duty has to be paid on it?
5. What aspects/ papers the departmental may look for while scrutinising the matter.
6. What precautions should be taken by the manufacturer so that no mistake creep in paper work?

PAID IN PLA.

Dear Sir,
We have two Units. All are Registered with Excise. Last month we have deposit 50,00.00 from Unit-I towards Excise duty in PLA vide Axis Bank.But that amount should be deposit from Unit-ii.
Now what is the solution for that?
Kindly inform me immediately

CENVAT CREDIT

HI MY FRIENDS WILL ANYBODY ANSWER MY QUERRY REGARDING THE ELIGIBILITY OF CENVAT CREDIT IN CASE OF CEMENT INDUSTRY MANUFACTURING CEMENT SHEETS OF VARIOUS SHAPES & SIZES.
ACTUALLY THE FACTORY IS AVAILING THE CREDIT WITH THE PURCHASES MADE WITH HPCL OR INDIAN OIL ETC. WILL THIS CREDIT WILL BE ALLOWED AS LDO,HSD AND PETROL IS SPECIFICALLY EXCLUDED FOR AVAILING CREDIT AND IF ALLOWED THEN IT SHOULD BE AN INPUT NOT AN CAPITAL GOODS.
SO IS THE FACTORY IS ELIGIBLE FOR THIS CREDIT.
2. MY SECOND QUERRY IS IF IT EXPORT THESE SHEETS TO NEPAL OR ITS NEPAL DEPOT WILL IT BE COUNTED FOR EXPORT OR CLEARENCES FOR HOME CONSUMPTION.
IF IT IS EXPORT THEN WHETHER ITS DUTY WILL BE PAID BY AVAILING THE CENVAT CREDIT OR FROM PLA.
3. IF THE FACORY HIRES AN GTA (GOODS TRANSPORT AGENCY)FOR REMOVING ITS DUTY FROM FACTORY GATE TO DEPOT OR BUYER PREMISES SO WILL IT (FACTORY) ELIGIBLE FOR CREDIT OF SERVICE TAX PAID TO IT AND IF THEN UP TO WHAT EXTENT.
4. CAN THE FACTORY AVAIL ABATEMENT AND CREDIT BOTH AT THE SAME TIME AND IF SOME OF THE SHEETS SOLD BY THE FACTORY IS DAMAGED THEN WHETHER CREDIT OF SERVICE TAX WILL BE AVAILED AT GROSS OR NET AMOUNT.

PLEASE HELP ME IN THIS MATTER.

RE CT-1

Dear Sir,
The Situation:
I am a Trader of Industrial Goods. Recently I need to resale some goods to a SEZ Unit. My supplier is exciseable manufacturer. But my customer is situated in SEZ and wants to avail SEZ Benefit of Excise free invoice.
The Problem:
a)I am not registered in Excise or SEZ therefore cant issue any CT-1 or etc form. b)The manufacturer needs to bill me only since the materials are to be routed via me (due to my hidden margins)
c)The customer has issued purchase orders in my name only.
Please HELP !! It Is most urgent

If the supplementay invocies raised against case booked by the dept. we eligible to take credit. If not possible take the credit pls refer me a rules and notifications
