Ssi unit- clubbing provisions

Sir/madam

Mr X is a MD of a Pvt Ltd co enjoying SSI Exemption. Other 3 directors are not related to him.
1.If he forms a partnership business, dealing with same product, along with his wife and son, whether clubbing provision applies ?.

2. If yes to above, then, only his wife and son are in partnership,then also clubbing provisions applies or not ?

Please provide a reasonable reply.

can one get refund of the excise duty paid on capital goods purchased which are inturn to be used in the manufacture of the goods which are to be exported?

If yes, Kindly let me know the procedure.

Excise query

why excise duty is deducted from sales ?

We have two registration. One is ending with EM0001 (revoked earlier by the department) and another is ending with EM0002. The tax was wrongly deposited under EM0001 instead of EM002. So please suggest whether this can be adjusted. If yes then how it can be done. If not then what we can best be do in this regard.

Cenvat credit

Kindly let me know whether Cenvat Credit of capital goods installed which is not put to use can be taken or not against excise duty payable at present.

This capital goods are purchased for different process in addition to existing manufacturing goods and still not put to use.

i.e. whether Cenvat on these capital goods which are not put to use can be taken against excise duty payable on existing manufacturing facilities.

Goods replaced during warranty

When goods are replaced during warranty,(i.e. damaged goods are returned by customer and new goods are sent back), what are the excise implications for this. kindly guide..
