Sir, I have completed my 11 months articleship, and I want to take transfer from here, but my principal ask for addition payment back (excess of base stipend as per ICAI paid), there is any rule to revert that or i can take transfer without it. What should I do now? Is there any clause which allow us to take transfer without submitting Form 109?

Regulation 67 of the CA regulation deal with Irregular payment or non payment of stipend, but it not talking about refunding of excess stipend.

You need not to revert or/and any excess payment to the employer to take termination there is no such rule.
To take termination form 109 submission is must and should. To take termination employer's willingness also required because of he has to sign on form 109. So many students are facing different un-official problems from their employer's to take termination etc..... because of institute doesn't making any provisions which are use full and favourable to the student at this type of situations. However you have choice to make a complaint against your employer for his demanding but before making complaint you have to very careful before that you have to take some precautions because there is a chance to employer to terminate you due to the misconduct of you behaviour.
